Terms of Service

Townsite is a small web services business in Wisconsin. We design, build and host websites for local businesses.

While your plan is active, we:

• build the full website from the home-page design you picked, and put it live within 2 work days (Monday to Friday) of your first payment, as long as we have what we need from you;
• host it, keep it secure with https, and keep it running;
• make the changes your plan includes: 2 a month on Website (unused ones carry over, up to 6 saved) or 8 a month on Website + Care (up to 16 saved). Changes beyond that cost $15 each on Website and $10 each on Website + Care. We show the price in your dashboard before you confirm, and charge it only once the change is live, on your next invoice;
• connect a web address (domain) you already own, or register a new one for you (see “Domains”).

One change is one thing: new hours, one menu's prices, up to 5 photos, or one section's text. A new page counts as 3. These never count as changes and are always free: edits you make yourself in your dashboard, fixing our mistakes or anything that's broken, and unlimited tweaks in the first 14 days after your site goes live.

For a bigger job, we tell you how many changes it counts as before we start. We never charge for extra changes without your OK. A full redesign, an online store, bookings or other new features are not included; we can talk about those separately.

Give us accurate details and keep your email account secure: we sign you in with codes and links sent to it. You can add team members. You're responsible for what people you add do in your account.

You must be at least 18 and allowed to act for the business you sign up.

Website is $29 a month or $290 a year; Website + Care is $59 a month or $590 a year, in US dollars, plus any sales tax that applies. There's no setup fee and no contract. Plans renew automatically until you cancel. Payments are handled by Stripe; we never see or store your full card number.

30-day money-back guarantee. If you're not happy within 30 days after your site goes live, tell us and we'll refund what you paid, minus the cost of any domain we registered for you (domain registrations can't be refunded). See the Cancellation & Refunds policy.

If a payment fails, Stripe retries it and we email you. If it's still unpaid after about two weeks, we may pause your site until it's paid. Paying brings it back.

If we change prices, we'll email you at least 30 days before the new price applies to you, so you can cancel first if you want.

Founding clients (anyone who subscribed at $15 a month or $150 a year) keep that price and 3 changes a month for 12 months. After that, their plan moves to Website, and we email them at least 30 days before it does.

You can cancel anytime from Billing. Your site stays up until the end of the period you've paid for. Details, refunds and what happens to your domain are in the Cancellation & Refunds policy.

Your business name, logo, photos, text and anything else you give us stay yours. You give us permission to use, copy, resize and edit them only to build, host and show your site (including showing you design previews).

You confirm you have the right to use what you send us. Before you subscribe, the designs we show you may use information and photos that are already public about your business; tell us and we'll remove anything you don't want used.

You can use the site we build for your business for as long as you subscribe. If you cancel, ask us and we'll send you a copy of your site's files, which you may keep using for your business. Our tools, templates and the Townsite service itself remain ours.

If you already own a domain, it stays yours; you point it at your site by adding a DNS record where it's registered.

If we register a domain for you, it's registered in your business's name. The yearly plan includes the first year of registration for one domain; on the monthly plan, you pay for the registration when you buy it. Domain registrations can't be refunded once made. We'll tell you before a domain renews and what it costs.

Your site must follow our Acceptable Use policy. We may take down content or pause a site that breaks it, and we'll tell you why.

We work hard to keep sites fast and online, and we host on Cloudflare's network. But no service is up 100% of the time, and we can't promise yours will be. We may need to take things offline briefly for maintenance.

The service is provided “as is”. To the extent the law allows, we don't make promises beyond what's written in these terms, and we aren't responsible for lost profits, lost business, or indirect damages.

To the extent the law allows, our total liability for any claim is limited to what you paid us in the 12 months before the claim. Nothing here limits rights you have that can't be limited by law.

You agree to cover us for claims caused by content you gave us or by your breaking these terms.

We may close an account that seriously or repeatedly breaks these terms. If we ever stop offering Townsite or close your account for no fault of yours, we'll give you at least 30 days' notice where we can, refund the unused part of any period you've paid for, send you your site's files, and help you move your domain.

If we change these terms in a way that matters, we'll email account owners before the change takes effect. Using the service after that means you accept the new terms.

These terms are governed by the laws of the State of Wisconsin. Any dispute will be handled in the state or federal courts located in Wisconsin. Before going to court, please email us: most problems are fixed faster that way.
